Welcome to FluentSpeak. These Terms and Conditions ("Terms") form a binding agreement between you ("you," "User") and FluentSpeak ("FluentSpeak," "we," "us," or "our"), governing your access to and use of the FluentSpeak mobile application, website, and related AI-powered language-learning services (together, the "Service").

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.

1. Eligibility

The Service is intended for users aged 13 and above. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

By using the Service, you represent that you meet these requirements and that any information you provide is accurate.

2. Description of the Service

FluentSpeak provides AI-powered language-learning tools, including voice-based conversation practice, text-based chat with AI tutors, pronunciation and fluency feedback, structured lessons, and progress tracking.

Certain features rely on third-party artificial intelligence, speech-recognition, and text-to-speech providers, as described in our Privacy Policy.

AI Note:
FluentSpeak's tutoring features use generative AI. Outputs are automatically generated and may occasionally be inaccurate, repetitive, or contextually imperfect. See Section 6.

3. Account Registration

To access most features, you must create an account using your email address and a password, or by signing in with Google.

You agree to provide accurate information, keep your login credentials confidential, and notify us promptly at support@fluentspeak.org of any unauthorized use of your account.

You are responsible for all activity that occurs under your account.

4. Subscriptions, Trials, and Billing

  • FluentSpeak offers free features and paid subscription plans ("Membership"), billed on a recurring monthly, quarterly, or annual basis through the Apple App Store, Google Play Store, or another payment processor we designate.
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal through your App Store or Play Store account settings.
  • If you subscribe during a free trial, any remaining trial period is forfeited immediately and your payment method will be charged.
  • Prices may vary by region and are subject to change with reasonable prior notice.
  • Except where required by law or by App Store/Play Store policy, payments are non-refundable.
  • We do not directly process or store your full payment card details. Payment processing is handled securely through the Apple App Store or Google Play.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Pakistani law, including PECA.
  • Upload, speak, or transmit defamatory, obscene, hateful, or harassing content.
  • Attempt to reverse-engineer, decompile, scrape, or extract the Service's models, source code, or datasets.
  • Use bots, scripts, or automated tools outside approved APIs.
  • Impersonate another person or organization.
  • Generate content involving minors in a sexual or exploitative manner, extremist material, or harmful content.

We may suspend or terminate accounts that violate this section, with or without prior notice.

6. AI-Generated Content; No Professional Advice

The Service uses generative AI and automated speech-recognition technologies. You acknowledge that:

  • AI responses, corrections, and scoring are generated automatically and may contain errors, omissions, or culturally insensitive phrasing.
  • The Service is an educational tool and does not constitute professional linguistic certification, translation, or interpretation services.
  • Due to the nature of machine-learning systems, similar AI responses may be generated for other users. You do not have exclusive rights to AI-generated responses.

7. Your Content and License Grant

"User Content" means voice recordings, text messages, profile information, and other material you submit through the Service.

You retain ownership of your User Content.

By submitting User Content, you grant FluentSpeak a worldwide, non-exclusive, royalty-free license to use, process, transcribe, and store it solely to operate, provide, secure, and improve the Service, including through third-party AI processing providers, in accordance with our Privacy Policy.

You represent that you have the legal right to submit your User Content and that it does not infringe any third-party rights.

8. Intellectual Property

The Service, including its software, design, trademarks, course content, and underlying technology (excluding your User Content), is owned by FluentSpeak or its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial language-learning purposes only.

9. Third-Party Services

The Service integrates third-party providers for functions such as AI processing, speech recognition, cloud hosting, analytics, and payments (each identified in our Privacy Policy).

Your use of such integrated third-party services may also be subject to their own terms and conditions.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law.

We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated outputs will always be accurate or suitable for every situation.

11. Limitation of Liability

To the maximum extent permitted by law, FluentSpeak and its officers, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any loss of data, profits, business opportunities, or goodwill arising from your use of the Service.

Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us during the twelve (12) months immediately preceding the claim.

12. Termination

You may stop using the Service and delete your account at any time through the application or by contacting support@fluentspeak.org.

We may suspend or terminate your access if you violate these Terms, create a security risk, misuse the Service, or where required by law, with notice where reasonably practicable.

Upon termination, your right to use the Service ends immediately. Sections 6–11 and 13–15 will continue to apply after termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection laws applicable in your country of residence, you agree that the courts of Pakistan shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

14. Changes to the Service and These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices.

We will notify you of any material changes through the application, email, or a notice on our website at least 7–14 days before the updated Terms take effect, except where immediate changes are required for legal or security reasons.

Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
